Why We Have Local Laws

RoadworksCouncil is vested with a variety of specific powers to control, regulate, licence or prevent and prohibit the matters deemed relevant to a local government under the Local Government Act.

These powers are administered through Local Laws adopted by Council and are reviewed, consulted on and approved by the State Government through the Department of Infrastructure, Local Government and Planning. Subordinate Local Laws are designed specifically to meet the needs of the Diamantina Shire area.

01 - Administration 2013

The purposes of this local law are to provide a legal and procedural framework for the administration, implementation and enforcement of the local government’s local laws, subordinate local laws and specified regulatory powers under the legislation, and to provide for miscellaneous administrative matters.

02 - Animal Management 2013

The purpose of this local law is to regulate and manage the keeping and control of animals in the local government’s area in a way that—
(a) balances community expectations with the rights of individuals; and
(b) protects the community against risks to health and safety; and
(c) prevents pollution and other environmental damage; and
(d) protects the amenity of the local community and environment.

The purpose of this local law is to protect the environment and public health, safety and amenity within the local government’s area.

04 - Local Government Controlled Areas, Facilities and Roads 2013

The purpose of this local law is to—
(a) protect the health and safety of persons using local government controlled land, facilities, infrastructure and roads; and
(b) preserve features of the natural and built environment and other aspects of
the amenity of local government controlled land, facilities, infrastructure and roads.

03 - Gates and Grids

The objects of this local law are to regulate gates and grids across public roads to ensure that theydo not interfere with either -
(a) the safe movement of pedestrians and vehicles; and/or
(b) the proper maintenance of the public road.

22 - Aerodromes

The objects of this local law are to -
(a) provide for rights of entry and use of aerodromes controlled by the Local
Government; and
(b) provide for fees and charges for the above rights; and
(c) provide for regulation of use of aerodromes; and
(d) provide for the powers and authority of persons authorised by the Local Government for the purposes of this local law; and
(e) provide for penalties for breaches of the local law; and
(f) provide for liability arising out of use of aerodromes.
